Subscription terms

1. Purpose and mandatory nature

A recurring subscription is mandatory for any site Philotechnos puts live. Depending on the plan (Essential, Comfort, Growth), it covers hosting, the domain name, the SSL certificate, backups, maintenance and a defined level of support. Where the client is a consumer and the subscription is concluded at a distance, the right-of-withdrawal provisions of article 18 of the General Terms apply; any request to start the subscription before the end of the legal period is made by the consumer's express request.

2. Start

The subscription starts on the site's go-live date and is billed periodically (monthly, quarterly or yearly as agreed). The exact billing frequency and the total amount due for the period are stated on the quote and communicated before acceptance. Go-live only happens after payment of the balance and activation of the recurring payment method.

3. Pricing

Essential €39/month, Comfort €69/month, Growth €119/month. Included services vary by plan. Given the initial 12-month term, the minimum total commitment over 12 months is €468 for Essential, €828 for Comfort and €1,428 for Growth; this amount is recalled before subscribing.

4. Scope of maintenance

The subscription covers hosting, the domain name, the SSL certificate, backups, technical and security updates, monitoring of proper operation and support depending on the plan. It does not cover redesigns, new features, content creation or major evolutions, which are subject to a separate quote.

5. Support and response times

Support is provided Monday to Friday, excluding Belgian public holidays. As an indication, the first response time is about 72h for the Essential plan, 48h for Comfort and 24h for Growth. These times concern handling the request, not resolving it, which depends on its nature and complexity.

6. Backups

Backups of the site are made regularly to allow restoration in the event of an incident. Their frequency and retention depend on the chosen plan and the host, and are specified in the quote or plan. Data deliberately deleted by the client may be excluded.

7. Recurring payment by mandate

The subscription is paid by recurring automatic debit. The client sets up a direct-debit mandate (SEPA) with Philotechnos's payment provider (e.g. Mollie); this mandate authorises collection of the agreed amount on each due date. The mandate and payments are subject to the payment provider's terms, communicated to the client on activation. Philotechnos does not store full bank details: they are handled by the payment provider.

8. Price revision

The price remains fixed during the initial twelve (12)-month term, save for a legal change in taxes or the client's express agreement. Thereafter, Philotechnos may revise the price — in particular where hosting, licence, provider or plan costs change — with at least two (2) months' notice given to the client. The client may then cancel free of charge before the new price takes effect. Continuing the subscription after the new price takes effect constitutes acceptance of it, the client having been clearly informed of their right to cancel free of charge before that date.

9. Term, renewal and cancellation

The subscription starts at go-live and has a minimum term of 12 months. After that period it renews for an indefinite term and remains cancellable at any time by either party with one (1) month's notice. Cancellation is made by email to contact@philotechnos.com; Philotechnos confirms receipt in writing. It takes effect at the end of the current period and amounts due for that period remain payable. Where the client is a consumer, mandatory cancellation rights continue to apply.

10. End of contract: domain name and files

Where possible, the domain name is registered in the client's name from the outset. When the subscription ends, hosting, the SSL certificate, backups and support stop at the end of the paid period: the site is then no longer online, unless migrated. The domain name remains the client's (transferred or kept in their name), after which the client handles its renewal with the registrar. The files the client owns after full payment for the build are provided as an export (specific code and content; some elements relying on third-party services may not be fully exportable). The client has thirty (30) days after the end of the subscription to retrieve these elements; the backups are then permanently deleted within sixty (60) days, unless otherwise required by law. The data of the client's site visitors (forms, accounts, bookings) is returned or deleted according to the client's instructions, in line with the applicable data-processing agreement. The transfer or migration is subject to a prior quote or is charged at the hourly rate stated in the initial quote.

11. Late or non-payment

If a debit fails, the client is notified. Where the client is a consumer, the first reminder is free and at least 14 calendar days are allowed before any fee or interest applies; reminders, interest and indemnities are governed by the mandatory provisions of Book XIX of the Code of Economic Law applicable at the time of the default. Failing regularisation, Philotechnos may progressively suspend services (support and maintenance, then hosting after a clear warning) and cancel the subscription in the event of repeated non-payment.

13. Acceptance

Subscribing implies acceptance of these terms and of the General Terms.
